This website is located on the web via the domain http://www.hawkeyevintage.com and includes all of the files located in that domain ("this site"). Agreement to these Website Terms of Use By accessing this site and our associated social media pages, you agree to be bound by these terms of use ("Website Terms of Use"). These Website Terms of Use constitute a binding agreement between you and the Company and govern your use of this site and any purchases you make from us. Privacy Policy As part of these Website Terms of Use, your use of this site and our associated social media pages is also subject to our Privacy Policy (located at http://www.hawkeyevintage.com/privacy), which is incorporated by reference into these Website Terms of Use. Legal capacity to transact If you are under 18 years of age, you cannot place orders through this site. By using this site you represent and warrant to the Company that you are over the age of 18 years. Should the Company suffer any damage or other losses as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from his/her parents or guardians. Authenticity Guarantee We sell 100% guaranteed authentic luxury vintage items. You may purchase a personalised Hawkeye Vintage Authenticity Card with each item for an additional fee of $45. Quality of Goods Sold We grade the quality of our vintage items as follows: β’ Pristine β’ Good β’ Shabby You understand that in purchasing goods from us, you are purchasing a vintage item. This means that our items have been previously owned by someone else, are in most cases used, and could be up to 60 years old. You understand that stains, fading, and wear and tear may be present on items we sell, and given their age, may deteriorate more quickly than items that are new. We take all of these factors into account when pricing and advertising our products, and unless an item is materially and substantially not as described, we do not offer refunds on any purchases (subject to our obligations under the Australian Consumer Law). Please refer to the description and photos provided in respect of any goods you may wish to purchase, and consider whether a vintage purchase is right for you. Entrupy Authentication Service Entrupy is an authentication solution using artificial intelligence and microscopic computer vision to confirm the authenticity of high value goods. You may purchase Entrupy Authentication with any item as follows: β’ Entrupy Authentication: $55 per items β’ Entrupy Hermes: $95 per item Orders Order constitutes offer By placing an order through this site, you make an irrevocable offer to us to purchase the products that you have selected pursuant to these Website Terms of Use. Information contained in this site constitutes an invitation to treat only. No information in this site constitutes an offer by us to supply any products to you β however, the Company will endeavour to supply your selected products to you. We will not commence processing any order made through this site unless and until: β’ payment for the order has been received by us in full; and β’ the order has passed our internal validation procedures, which are undertaken in order to verify the bona fides of each order for the purpose of preventing credit card and other fraud. We reserve the right at our discretion to: β’ at any time prior to your order being accepted in accordance with these Website Terms of Use, cancel all or part of your order; and β’ at any time: - refuse to provide products to you; - terminate your access to this site; and/or - remove or edit any content on this site. Acceptance of orders Acceptance of each order will take place if and when the Company ships the requested items to you, at the time at which the items are despatched by the Company. Title to, and risk in, the items will pass from the Company to you at that time. After the items have been sent, we will send you an email confirming that shipment has taken place. Prices We reserve the right to change the prices for products displayed in this site at any time before you place an order. Shipping costs and times Shipping costs will depend upon the location for delivery and the items purchased and are shown separately during checkout. Instagram Sale purchases: all shipping Australia wide is $15 for two items. International Shipping is $25 for two items. Website purchases: all shipping Australia wide is a $15 flat rate. International Shipping is a $25 flat rate. We endeavour to ship items from our Australian office within 1-7 business days of receiving cleared payment. Purchases made online via our website may take up to 14 days for delivery. You will receive tracking from Couriers Please or Sendle. Express shipping If you require your items quickly, we offer express shipping at an additional price, depending on your destination. Please email info@hawkeyevintage.com with your order details for more information on express shipping pricing. Insurance Risk and title to any items purchased passes to you once we receive payment in full and the item is shipped. For this reason, we highly recommend that you purchase insurance for any items you purchase from us. Insurance can be purchased for $25 per parcel up to the value of $1,500. Should you purchase one or more item over the value of $1500, insurance will be $25 per item. GST Unless otherwise expressly stated, all amounts payable through your use of this site are expressed to be inclusive of GST. For these purposes, the term "GST" has the meaning given to it in the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Payment Payment for orders placed through this site may be made by one of the methods displayed at checkout (including PayPal, PayMate, and ZIP). Surcharges or fees payable on the various payment options are payable by you and will be calculated at checkout. Lay-By Agreement Lay-by payment plans are available by selecting the lay-by option at checkout. The terms of our layby payment plans below are called a Lay-By Agreement. We require a deposit of 25% of the total purchase price up front (including GST), and full payment for the goods within eight (8) weeks from the date of payment of the deposit. You may terminate the Lay-By Agreement by providing us notice in writing. If you fail to pay the full purchase price within the time specified above, we are entitled to terminate the Lay-By Agreement. If the Lay-By Agreement is terminated for any reason, we will charge you a termination fee equal to the total sum paid by you under the Lay-By Agreement up to the date of termination. Refunds and other remedies Except as expressly provided otherwise in these Website Terms of Use, all amounts paid to us are nonrefundable. Further information on the steps that the Company will take to remedy any breach of any non-excludable condition or warranty/guarantee is provided under the heading "Remedies limited" in these Website Terms of Use below. Approval of registrations The Company reserves the right to accept or reject any application for registration of an account with this site at its discretion. Security While our payment processing and website hosting providers employ secure technology for transactions with our customers, we will not be responsible for any damages, including consequential losses (whether direct or indirect), that may be suffered by a customer whose credit or debit card or bank account information is used in a fraudulent or unauthorised manner by any person other than the Company. The Company may request further information from you, such as a copy of your credit card and/or other identification documentation, as part of our internal validation procedures.
